Florida Condominium Website Law
On June 26, 2017, Governor Rick Scott signed HB 1237 into law, amending Florida Statutes 718. This legislation mandated that any association with 150 units or more must have a website to post digital copies of official records.
In 2024, this requirement was expanded to include associations with 25 units or more, adding more content requirements. Associations with 25 to 149 units have until January 1, 2026, to comply, while those with 150 units or more have been required to comply since January 1, 2019.
*Note: HB 1237 (2017) has similar language to HB 653 (2017) regarding the website requirement.

Updates:

March 6, 2024: Lawmakers unanimously passed HB 1021 and SB 1178, reducing the website requirement threshold for condominium associations to 25 units or more and adding new content requirements.

June 14, 2024: Governor Ron DeSantis signed HB 1021 into law.

718.111(12)(g), Florida Statutes
An association managing a condominium with 25 or more units (excluding timeshare units) must post digital copies of the documents specified in subparagraph 2 on its website.
The association’s website must be:

An independent website or web portal wholly owned and operated by the association; or
-
A website or web portal operated by a third-party provider with whom the association has a contractual agreement.
The website must be accessible through the Internet and have a section inaccessible to the general public, only accessible to unit owners and employees of the association. Upon written request, the association must provide a unit owner with a username and password to access these sections.
Documents to be posted include:

The recorded declaration of condominium and its amendments.

The recorded bylaws and amendments.
-
The articles of incorporation and amendments.
-
The association's rules.
-
Executory contracts, documents, and bids over $500.
-
Annual budget and proposed budget.

Financial reports and monthly income/expense statements.

Certification of each director.
-
Contracts or transactions with conflicts of interest.
-
Notices and agendas of unit owner and board meetings.
Additional requirements added in 2024:

Inspection reports.
-
The most recent structural integrity reserve study, if applicable.
-
Copies of all building permits.
